As a drug crimes criminal defense attorneys in Westchester County we routinely represent clients with serious drug addiction problems. Many of our clients want to stop using drugs and their family members want to help in any way possible.
Unfortunately, we usually meet our clients after an arrest for a drug crime ( possession and/or sale) or a larceny charge (stealing, issuing a bad check, credit card fraud, robbery) to support a drug habit. When our clients are charged with a drug crime and/or larceny related type offense we review the case from two points of view:
- Legal – We need to quickly determine the legal drug crime defense(s). This includes Miranda violations, search and seizure violations, laboratory errors, chain of custody errors, search warrant issues, confidential informant problems and many other areas to determine the weakness of the criminal case.
- Treatment – Does the client need or can benefit from a drug treatment program? If yes, what type of program is needed? What is the best location for the client? What are the costs associated with the drug treatment program?
Our firm also works closely with family members to keep the family informed about the criminal defense and drug treatment program, including aftercare recovery.
The drug crime arrest, treatment and the criminal defense:
Recently, our firm received a telephone call from a mother whose son had a serious heroin addiction and was arrested for stealing. The family hired our firm and we immediately met with the client at the Westchester County Jail for an interview.
We determined that the client's arrest for check fraud was his way of funding his drug addiction. After contacting the district attorney and the court our firm successfully argued that the best place for the client was not in jail but in a treatment program. Within days they client was released from the jail to the program my office suggested.
It was not easy for our client and it took months to resolve but the client graduated from the program, entered a halfway house and then ultimately returned to his old job living by himself near his family. He continues with treatment on an as needed basis.
Legally, the criminal case was resolved in our client's favor with a non-criminal disposition of disorderly conduct with a promise to continue in drug treatment as recommended by the program.
