If you already have an order of child support from either the Westchester County Supreme Court (located in White Plains) or the Westchester County Family Court (located in White Plains, Yonkers and New Rochelle) and your child's other parent fails, neglects or simply refuses to pay court ordered child support, you can take immediate action to enforce your legal rights. This is accomplished by the filing of an enforcement proceeding in either the Westchester County Supreme Court or the Westchester County Family Court. However, in order to file in the Westchester County Supreme Court your existing order must be an order of the Westchester Supreme Court otherwise you will file the enforcement proceeding in the Westchester County Family Court.

In order to effectuate the enforcement of the child support order both courts can:

  • grant you a money judgment against the non-paying parent which can then be effectuated through am income execution (wage garnishment);
  • direct the non-paying parent to put up security for future payments;
  • appoint a receiver of the non-paying parent's property;
  • hold the non-paying parent in contempt of court in which case the court could impose a jail sentence of up to six months.

Obtaining the assistance of the Westchester County Child Support Services

In addition to the other methods of enforcing child support orders discussed above, any person who is supposed to receive court ordered child support may request that the court order and direct that the child support payments be payable through the Westchester County Support Collection Unit. When this happens, the Westchester County Support Collection Unit will immediately issue an income execution to collect the child support.

Enforcing child support orders from other counties in Westchester County, NY

When this is the case, for so long as one of the parents resides in Westchester County, the same rules as discussed above will apply.
